Preamble: Policy and Guidelines .

Purpose
  For the proper safety of the citizens of Los Santos and its enforceable counties while ensuring the  
  prevention of alienation of the rights and protections of the citizens and their property.
  To maintain the Amendment rights to proper procedure, unusual crime & punishment.

  Policy of Time Allocation
  *Note: Differs from the original government release for clarification purposes only!
  Law Enforcement use the Penal Code as a guideline for placing individuals who accept GUILTY status to all
  their charges.

 
• Law Enforcement must imprison suspects for the lowest time defined by each charge unless the suspect
    has excessively failed to comply or committed given crimes in a very serious manner: if that happens, law
    enforcement officers may imprison such suspects for a time up to the middle time between the minimum and
    maximum time defined by the charges. For example, a charge that has 1 hour as minimum and 3 hours as
    maximum would allow law enforcement officers only to imprison someone with that charge for up to 2 hours.
  
   
  
• WHY? The District Attorney's Office and Court Services Division of the State may use higher times and
    punishments should individuals be found guilty following due process. Individuals who accept immediate arrest
    and imprisonment are accepting de-facto pleas.
  
   
  
• The ONLY EXCEPTION to this is listed in the Amendments, with regard to crimes committed against
    Government Employees.
  

  Facility of Imprisonment*
  Charged individuals shall be:

 
• Imprisoned in San Andreas Correctional Facility if their calculated punishment length exceeds 60 minutes;
   
  
• Imprisoned in county jail if their calculated punishment length is 60 minutes or less;
   
  
• Imprisoned at the officer's discretion (prison/jail) if their calculated punishment length is between 45-60
    minutes.

Book of Laws Page 1 - Road Offenses.

(1)01. Exceeding the Speed Limit
An individual who exceeds the speed limit allowed in that specific region.
• Penaly Code (1)01 is an Infraction of $500 (standard amount).

(1)02. Nitrous Oxide Possession
An individual who modified his/her vehicle with NOS.
• Penalty Code (1)02 is an misdemeanor punishable by no less than 20 min. imprisonment and no more than 40 min. imprisonment as well as an impoundment of the individual's vehicle.

(1)03. Illegal Usage of Hydraulics
An individual who modified his/her vehicle with hydraulics.
• Penalty Code (1)03 is an Infraction of $2000 (standard amount).

(1)04. Tinted Windows
An individual who modified his/her vehicle with tinted windows making the individual unable to be identified.
((Driving and claiming you cannot be identified in the vehicle while driving is the OOC justification to this.))
• Penalty Code (1)04 is an Infraction of $800 and a warning on the driver's license at the officer's discretion.

(1)05. Driving under the influence of Alcohol or Narcotics
An individual who drives or operates a vehicle while under the influence of Alcohol above the legal limit of 0.88% BAV, or under the influence of performance-altering narcotics.
• Penalty Code (1)05 is an misdemeanor punishable by no less than 60 min. imprisonment and no more than 140 min. imprisonment.

(1)06. Driving without a valid license
An individual who drives or operates a motorized vehicle without a valid license registered on the driver.
• Penalty Code (1)06 is an misdemeanor punishable by no less than 40 min. imprisonment and no more than 90 min. imprisonment as well as an impoundment of the individual's vehicle at the officer's discretion.

(1)07. Registration Violation
A vehicle driving on a state, county, or local road without an official owner’s registration or lease registration on file.
• Penalty Code (1)07 is an Infraction by $1.200 as well as a driver's warning and an impoundment of the individual's vehicle at the officer's discretion.

(1)08. Street Racing
Performing an unlicensed or undesignated race or competition on city, county, or state paved roads or courses that incites the potential for other violations or demonstrates a potential for hazard.
• Penalty Code (1)08 is a misdemeanor punished by no less than 70 min. imprisonment and no more than 140 min. imprisonment as well as an impoundment of the individual's vehicle at the officer's discretion.

(1)09. Reckless driving
An individual who does not use care or caution while driving his or her vehicle with blatant disregard for the safety of others, safety of his or her self, or violation of general expected vehicular conduct while on the road.
• Penalty Code (1)09 is an Infraction by $2.000 as well as an impoundment of the individual's vehicle at the officer's discretion.

(1)10. Illegal parking
- An individual who parks their vehicle in a manner that completely obstructs and prevents traffic on a road or sidewalk.
- An individual who parks their vehicle in a manner that is not necessarily obstructive, but dangerous.
Note: As it is the responsibility of the property owner to maintain the facility and surrounding land (excluding road, but including sidewalk,) it is at the discretion of the property owner to determine parking rules for sidewalk and land surrounding their facility, so long as it does not violate any of the above policies.
• Penalty Code (1)10 is an Infraction by $1.100 as well as an impoundment of the individual's vehicle at the officer's discretion.

(1)11. Not using seatbelt
An individual whose seatbelt is not buckled up or a vehicle where the passengers don't have their seatbelt buckled up.
• Penalty Code (1)11 is an Infraction by $400.

(1)12. Trespassing areas closed for traffic
Trespassing certain areas which are closed for traffic. Ex.: Railroads,Sewer lines, crossing railroads at the wrong spots, areas closed due roadworks or any other reason.
• Penalty Code (1)12 is an Infraction by $1.400 as well as an impoundment of the individual's vehicle at the officer's discretion.

(1)13. Driving on the wrong lane
An individual who drives on the wrong lane. ((White boarder line on the passenger side))
• Penalty Code (1)13 is an Infraction by $1.000 as well as an impoundment of the individual's vehicle at the officer's discretion.

(2)01. Possession of an illegal blade
Any person who carries a concealed weapon within their person, vehicle, place of business, or other facility without proper relevant permits or with the knowledge of an individual within their vehicle, place of business, or other facility in violation of such a permit and law.
• Penalty code (2)01 is a felony punishable by no less than 100 min. imprisonment and no more than 120 min. imprisonment, the individual will be put on a trial period after release.

(2)02. Carrying an unlicensed firearm
Any person who carries a concealed weapon within their person, vehicle, place of business, or other facility without proper relevant permits or with the knowledge of an individual within their vehicle, place of business, or other facility in violation of such a permit and law.
• Penalty Code (2)02 is a misdemeanor punishable by no less than 120 min. imprisonment and no more than 150 min. imprisonment as well as a license application by the individual will be denied in the future. The individual will be put on a trial period after release.

(2)03. Possession of an Assault Weapon
Any person who possesses an assault weapon which use a high-velocity or high-damage bullets.
• Penalty Code (2)03 is a felony punishable by no less than 120 min. imprisonment and no more than 180 min. imprisonment. The individual will be put on a trial period after release.

(2)04. Unlicensed Sale of Firearms
Any person who illegally sell firearms or improvised devices of any type without proper permits or permissions
• Penalty Code (2)04 is a felony punishable by no less than 120 min. imprisonment and no more than 180 min. imprisonment. The individual will be put on a trial period after release.

(3)01. Discharging a firearm from a motorized vehicle
An individual who drives a vehicle and has a passenger who they knowingly and willingly let discharge a firearm from within the vehicle, as well as the actual individual who discharges the weapon in the vehicle.
• Penalty Code (3)01 is a felony punishable by no less than 80 min. imprisonment and no more than 150 min. imprisonment as well as an impoundment of the individual's vehicle.

(3)02. Driving with a suspended driver license
An individual who drives or operates a vehicle with a revoked or suspended driver license.
• Penalty Code (3)02 is a misdemeanor punishable by no less than 20 min. imprisonment and no more than 80 min. imprisonment as well as an impoundment of the individual's vehicle.

(3)03. Hit and run
Every person who commits hit and run after a person was injured. If killed include manslaughter charges.
• Penalty Code (3)03 is a felony punishable by no less than 160 min. imprisonment and no more than 240 min. imprisonment as well as an impoundment of the individual's vehicle.

(3)04. Hit and run involving property damage
Every person who commits hit and run without injury to individuals but creates the destruction of public or private property.
• Penalty Code (3)04 is a felony punishable by no less than 180 min. imprisonment and no more than 240 min. imprisonment as well as an impoundment of the individual's vehicle and a suspension of the driver's licenses.

(4)01. Obstruction of a Police Officer.
A clear and motivated attempt to prevent an officer from committing his or her duty while in the line of duty. non-compliance with an officer if said non-compliance affects the safety of the officer, the individual, or anyone in their immediate surroundings.
• Penal Code (4)01 is a misdemeanor punishable by no less than 15 minutes imprisonment and no more than 25 minutes imprisonment.

(4)02. Resisting a Police Officer
Evading or avoiding apprehension or contact with an officer by non-vehicular means, or resisting apprehension by any physical means.
• Penal Code (4)02 is a misdemeanor punishable by no less than 15 minutes imprisonment and no more than 25 minutes imprisonment.

(4)03. Corruption of Public Duty
The act of pursuing outside the interests of the public good, public justice, or duties of those serving as public servants.
• Penal Code (4)03 is a felony punishable by no less than 240 minutes imprisonment and no more than 300 minutes imprisonment as well as removal from office.

(4)04. Tampering With Evidence
Any person who destroys or attempts to destroy, conceals or attempts to conceal, or alter any evidence of that can later potentially impede the duties of relevant departments of justice.
• Penal Code (4)04 is a felony punishable by no less than 120 minutes imprisonment and no more than 180 minutes imprisonment.

(4)05. Failure to Identify to a Police Officers
A person who fails to acknowledge a Peace Officer or other legal authority his or her identity with a name or handle.
• Penal Code (4)05 is a misdemeanor punishable by no less 15 minutes imprisonment and no more than 25 minutes imprisonment, continue to refuse will lead to a higher penalty.

(4)06. Failure to pull over when indicated by a Police Officer
A person who fails to pull over when an Officer requests to.
• Penal Code (4)06 is a felony punishable by no less than 40 minutes imprisonment and no more than 90 minutes imprisonment as well as impoundment of the driver's vehicle.

(4)07. Failure to pay a fine
A person who's issued with a fine but which she/he did not pay within the time ordered without a lawful excuse. ((This counts even when you paid the full fine after the time ordered!))
• Penal Code (4)07 is a misdemeanor punishable by no less than 15 minutes imprisonment and no more than 30 minutes imprisonment

(4)08. Attempted murder on a Police Officer
A person who attempts to murder a police officer.
• Penal Code (4)08 is a felony punishable by no less than 240 min. imprisonment and no more than 300 min. imprisonment.

(4)09. Insult to a Police Officer
A person who uses foreign language while talking to a Police Officer.
• Penal Code (4)09 is a misdemeanor punishable by no less than 10 min. imprisonment and no more than 15 min. imprisonment. A fine with a sum of $300 may be given instead.

Book of Laws Page 5 - Seatbelt legislation .

Seatbelt legislation in Los Santos:

Buckling up a seatbelt is a must in all motorized vehicles (except buses). A police officer may and will pull a driver over whose seatbelt is not buckled up or whose passengers' seatbelt is not buckled up. This is so called: Primary Enforcement.*

*A police officer may unbuckle his seatbelt while patrolling, if an officer is driving to a location for private reasons he must have his seatbelt buckled.
